Elemental Yoga® is a platform where users can access online yoga and meditation content. This privacy policy describes our policies and procedures regarding the collection, use, and disclosure of the personal information we collect from users of elemental.yoga (the “Website”). Collection of data from users of cosmiccollective.net (Cosmic Collective) is governed by a separate privacy policy

INFORMATION WE COLLECT

Information You Provide

When you sign up for our mailing list, you provide us with certain personal information that includes your name and email address. We may combine the information you submit under your account with information from third parties, such as Mighty Networks and Google, in order to provide you with a better experience and to improve the quality of our services.

Information We Collect As You Use Our Services

Your apps, browsers, and devices

We also collect information about the apps, browsers, and devices you use to access the Website, which helps us understand your use of the Website better, and thereby improve the Website over time. 

The information we collect includes unique identifiers, browser type and settings, device type and settings, and operating system. We also collect information about the interaction of our apps and your browsers and devices with our Website, including IP address, crash reports, system activity, and the date, time, and referrer URL of your request. We may determine your location based on your IP address in order to understand the demographics of our user base, to enhance security, and for fraud prevention. 

Your Activity

We also collect information about your activity on the Website so that we can do things like recommend better content to you in the future and create Cosmic Collective content that better serves the interests of all of our users. We use various industry-standard technologies to collect and store information, including cookies, pixel tags, local storage, such as browser web storage or application data caches, databases, and server logs. We may format hyperlinks in a format that enables us to keep track of whether these links have been followed.

WHY WE COLLECT DATA

We collect information from you to provide the Website to you, to maintain and improve the Website over time, and to develop new services. For example, we analyze content searching and viewing patterns across the Website for our users in order to determine what new content to provide. We also monitor and measure the performance of the Website in order to improve and optimize the design of the Website. 

We also use the information we collect, such as your email address, to interact with you. For example, we may send you newsletters, provide customer support, and notify you of essential changes to the Website and related services. 

Finally, we use information you provide to help improve the safety and reliability of the Services, including detecting, preventing, and responding to fraud, abuse, security risks, and other technical issues that could harm our users.

We will always ask for your consent before using your information for a purpose that isn't covered in this Privacy Policy.

WHEN WE SHARE YOUR INFORMATION

We do not share your personal information with companies, organizations, or individuals outside of Elemental Yoga and Cosmic Collective, except in the following cases:

External Processing. We may share your personal information with trusted, third-party service providers to facilitate certain aspects of the services. For example, we use a community platform provider to host the Collective. These third parties have access to your information only to perform these tasks on our behalf and are legally obligated not to disclose or use it for any other purposes. 

For Legal Reasons. We will share personal information outside of the Collective if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to: 

      • Meet any applicable law, regulation, legal process, or enforceable governmental request.

      • Enforce applicable Terms of Service, including investigation of potential violations. Detect, prevent, or otherwise address fraud, security, or technical issues.

      • Protect against harm to the rights, property or safety of Chad, our users, or the public as required or permitted by law.

We may share non-personally identifiable information publicly and with certain business partners. For example, we allow specific partners to collect information from your browser or device for our Website measurement purposes using their cookies or similar technologies.

If Elemental Yoga is involved in a merger, acquisition, or sale of assets, we will continue to ensure the confidentiality of your personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy. 

To be clear, we do not sell your personal information. We are a subscription-supported service, not an advertising-supported service.

KEEPING INFORMATION SECURE

We have internal policies and procedures in place to ensure that your information remains secure. We restrict access to personal information to employees, contractors, and agents who need that information in order to process it. Anyone with this access is subject to strict contractual confidentiality obligations and would be disciplined or terminated if they fail to meet these obligations. 

EXPORTING AND DELETING YOUR INFORMATION

We retain your information for as long as you subscribe to our newsletters. Except as described in the next paragraph, you can delete all of the personal information we have about you by unsubscribing. Alternatively, if you would like us to delete your record in our system, please contact us and we will attempt to accommodate your request if we do not have any legal obligation to retain the record. 

In some cases, we retain data for limited periods when it needs to be kept for legitimate business or legal purposes. Sometimes business and legal requirements require us to retain certain information, for specific purposes, for an extended period of time. Reasons we might retain some data for longer periods of time include: data security, fraud and abuse prevention, financial record-keeping, complying with legal or regulatory requirements, and ensuring the continuity of our services. 

COMPLIANCE AND COOPERATION WITH REGULATORS

We regularly review this Privacy Policy and make sure that we process your information in ways that comply with it. 

LAWFUL BASIS FOR PROCESSING

We process personal information with your consent (for example, when you agree that we may use cookies, or when we process personal information submitted for specified purposes). We may also process personal information when we need to do this to fulfill a contract (for example, for billing purposes) or where required to do so by law. 

We may also process personal information when it is in our legitimate interests to do this (for example, for customer service or fraud detection) and when these interests are not overridden by your data protection rights. If you wish to exercise the right to withdraw consent, please contact us (see below). 

DATA TRANSFERS

We maintain servers around the world and your information may be processed on servers located outside of the country where you live. Data protection laws vary among countries, with some providing more protection than others. Regardless of where your information is processed, we apply the same protections described in this policy.  

YOUR RIGHTS

You have the right to the following:

    • To request access to the personal information we hold about you;

    • To request that we rectify or erase your personal information;

    • To request that we restrict or block the processing of your personal information;

    • Data Portability: Under certain circumstances, to receive personal information about you that we store and transmit to another without hindrance from us, including requesting that we provide your personal information directly to another; and

    • Where we previously obtained your consent, to withdraw consent to processing your personal information.

When we receive formal written complaints, we respond by contacting the person who made the complaint. We work with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of your data that we cannot resolve with you directly. 

RETENTION

As described above, we will process and store your personal information only for the period necessary to achieve the purpose of the storage, or as permitted by law. We will retain and use your personal information to the extent necessary to enforce our agreements. The criteria used to determine the period of storage of personal information is the respective statutory retention period or six years in the case of contracts. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of a contract or the initiation of a contract or for other lawful purposes. 

CHILDREN’S PRIVACY

The Services are intended for a general audience and are not directed at individuals under the age of majority. We do not knowingly collect information from children or other individuals who are not legally able to use the Website. If we obtain actual knowledge that we have collected information from a child, we will promptly delete it, unless we are legally obligated to retain such data. If you believe that we have mistakenly or unintentionally collected information from a child, please contact us. 

CHANGES TO THIS POLICY

We change this Privacy Policy from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We always indicate the date the last changes were published. If changes are significant, we’ll provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes).
